1.       Criteria for All Entries

a.        The Verbatim Photo Contest is valid only in the United States and Canada.  Entrants must be a resident within those countries.

b.       All photographs must be original and must not be previously published.

c.        Verbatim reserves the right to disqualify any entries that violate any U.S. laws or other relevant laws or standards that may apply.

d.       Entrants are responsible for ensuring that their entries do not violate any applicable laws.

e.        Employees of Verbatim Americas LLC, its affiliates or subsidiaries are not eligible to participate.

f.        Entries will be accepted between the dates of March 17, 2009 and June 22, 2009.  No entries will be accepted after 5:00 p.m., Eastern Daylight(Standard) Time on June 22, 2009.

g.       All entries must be submitted via the internet at www.photostorageguide.com in a JPEG file format, not to exceed a maximum file size of 3MB.  Files larger than 3MB must be compressed prior to submission.  Photos submitted in file formats other than JPEG will not be accepted.

h.       Only one submission of each image is allowed.

i.         Entrant must be 18 years of age (on the date of entry) to participate.

j.         No purchase or payment is necessary to win.

2.       Entry Instructions

a.        Each entrant may enter a maximum of two JPEG photos.

b.       The Verbatim Photo Contest Entry Form must be completed online and submitted with the photos.

c.        Entrants will not be notified of the receipt of their entries and no photos will be returned by Verbatim.

3.       Judging

a.        Verbatim will be solely responsible for selecting the judges for the contest.

b.       Verbatim reserves the right to select the criteria for determining the winning photographs.

c.        Decisions by judges are final and no correspondence will be maintained with regard to judging.

4.       Notification of Winners

a.        Verbatim will notify the contest winner via e-mail no later than July 31, 2009.

b.       The winner may be requested to provide a higher-resolution image for the purpose of producing publications or exhibitions related to the contest.  Submitted work and storage media will not be returned to the winner.

5.       Prizes

a.        Prizes to be awarded to winning entrants will be listed on Verbatim’s contest web page, www.photostorageguide.com.  Verbatim reserves the right to substitute prizes of equal or greater value at its sole discretion.

6.       Disclaimers

a.        In the event that the efficiency, security, selection procedure, fairness of the contest or any related operations are deemed to have been compromised by forces beyond the control of Verbatim, such as computer network, computer virus or unauthorized computer access, some or all entries received via the Internet may be postponed or discontinued.

b.       Entrants are responsible for any and all costs of entry.

c.        Winners are entirely responsible for all taxes or charges related to any prizes awarded.

d.       Verbatim shall not be responsible for any problems or damages experienced by the entrant due to forces beyond its control, including but not limited to problems related to computer networks, computer virus infections or unauthorized computer access.

e.        Verbatim shall not be responsible for any damage to or loss of photos submitted or for any unfortunate or unwelcome occurrences that may be experienced by entrants as a result of their entries in the contest.

7.       Responsibilities of Entrants

a.        By entering a photo in the contest, entrants are deemed to have read, understood and agreed to these Verbatim Photo Contest Entry Rules.

b.       By entering the contest, entrants agree that they possess the exclusive rights to each photo entered and are responsible for obtaining, and have obtained, any and all necessary permissions related to the subject and/or subject matter contained therein, including a model release from persons who are recognizable in any photo.  A sample model release form can be found at http://www.photostorageguide.com/contest/model-release.cfm.  The entrant further agrees to indemnify and to hold Verbatim harmless in any third party claims related to the subject or subject matter of entries.   The above terms and conditions relating to the entrant’s responsibilities apply equally to Verbatim, its affiliates, its customers, the contest judges and other contest entrants.

c.        Through contest entry, entrants further agree that they are responsible for ensuring that entries are made within all applicable laws and that entries are made under their own responsibility and at their own risk.

8.       Rights of the Organizer

a.        Verbatim reserves the permanent nonexclusive right to publish, reproduce, display, distribute, and show on screen any entered photographs on Web sites, photo exhibitions, tradeshows, or any other media which is under the management of Verbatim for the purpose of promoting the contest.  In all cases where photographs are used, Verbatim reserves the right to do so without obtaining the further permission of the entrant and without offering any further compensation in any form.  These rights shall also apply to Verbatim and its subsidiaries and affiliates.

b.       Verbatim and its subsidiaries and affiliates reserve the right to (a) display some or all parts of the winning works accompanied by additional effects, such as computer graphics, sound effects or music on Web sites managed by the organizer and its subsidiaries and affiliates and (b) to reproduce some or all parts of the winning works for the purposes of producing announcement posters, tickets, brochures or other marketing collateral materials.  Winners may not exercise any copyright or personal rights against Verbatim to the photos used.

c.        Should Verbatim, its subsidiaries or affiliates wish to publish a submitted photograph for purposes other than the contest, a separate agreement will be required.

d.       Verbatim will announce names of winners and titles of winning works on its website or by other means as it may so choose. 

e.        Verbatim reserves the right to disqualify any entries that do not meet the terms and conditions contained herein and may revoke winner status and any awarded prize in the event that an entry is found unsuitable after the prize is awarded.

f.        All terms and conditions regarding entry to the contest shall be governed by the laws of the State of North Carolina.  Any entries made from outside this jurisdiction shall also be subject to those laws.

9.       Use of Personal Information

a.        Personal information may be given on the entry form at the entrant’s sole discretion.   However, failure to provide certain information may prevent the entry from being accepted by Verbatim.

b.       Where absolutely necessary for the management of the contest, Verbatim shall provide any personal information provided by entrants to its subsidiaries, affiliates, and third parties directly related to the management of the contest.  Except as provided in 8(d), Verbatim will not use personal information provided by entrants for any purpose other than the contest.

c.        Verbatim shall be responsible for the reasonable protection of personal information provided by entrants, including protection from unauthorized access by third parties.
